PLEASE TAKE A MOMENT TO READ THE FOLLOWING INFORMATION:
This Waiver confirms that by booking a session and/ or accessing the services provided by Nemadhi LLP (hereinafter referred to as “Firm”), You (hereinafter referred to as “I”, “Me”, and “My” depending on the context), and in the case of a Minor, the parent or legal guardian of such Minor acknowledge, understand, and agree to the following:
- I retain full autonomy and sole responsibility for all decisions made, actions taken, whether during or after any counselling sessions.
- I acknowledge that the Counsellor is not responsible for decisions, actions, or omissions that I make independently, including where I choose not to follow professional recommendations.
- I acknowledge that any recommendations, suggestions, and therapeutic guidance given is in a professional capacity and does not constitute any guarantee, assurance, or warranty of a particular outcome. I understand that counselling outcomes may vary from person to person and depend on a range of variable factors.
- To the maximum extent permitted under applicable law, I waive any and all rights, claims, causes of action, or rights to pursue action against any consequences arising from:
a. My own actions or decisions;
b. My reliance on counselling guidance;
c. My refusal or failure to follow professional recommendations; or
d. My discontinuation of counselling services. - The Services provided do not constitute emergency medical or psychiatric services. If I am experiencing a mental health emergency, suicidal thoughts, risk of self-harm, or poses a risk to the life or safety of myself or any other person, I will immediately contact:
a. Local emergency services;
b. Licensed medical professional;
c. Suicide prevention helpline; or
d. The nearest hospital or emergency care provider. - Regardless of the State or Country that I am a resident of, I confirm that any information that I either fill in or share with the Firm during booking or sessions respectively is completely voluntary and is shared out of my informed consent after a thorough perusal of the website’s Terms of Use, Privacy Policy, and this Waiver.
- I further understand that it might be mandatory for the Firm to share certain information disclosed by Me, when required by law, including under mandatory reporting obligations, and that such disclosure shall not require my consent. The Counsellor will, wherever practicable, inform me before any such disclosure is made.
- Where I choose to avail a DMIT-based personality or career assessment, I acknowledge and consent to the following:
a. The assessment involves the collection and analysis of my fingerprints;
b. All appropriate security measures shall be adopted to prevent any data breach;
c. My data shall not be retained beyond the assessment process and will be permanently deleted within 5 (five) business days from the date the results are furnished to me. - Where I participate in a corporate workshop, school counselling session or awareness programme, I consent to and acknowledge that:
a. My organisation may share my data with the Firm as part of the engagement process;
b. The Firm is not responsible for any additional information shared by my organisation without any such request by the Firm. I agree to direct any grievances regarding such additional information sharing to my organisation directly. - Where I participate in any couples, family, or group therapy, workshop, or programme involving other participants, I acknowledge that such other participants may disclose information concerning me during the course of such sessions. I agree that the Firm and the Counsellor shall not be responsible or liable for any such disclosure by another participant.
- I understand that all information shared during counselling sessions is treated as confidential by the Counsellor and the Firm. I also understand that confidentiality has limits, and that the Counsellor may be required or professionally obligated to disclose information without my consent where:
a. There is a risk of serious and imminent harm to myself or to any other person;
b. Disclosure is required under a mandatory legal or statutory obligation; or
c. A court of law or other competent authority orders such disclosure. - I confirm that I shall not audio-record, video-record, photograph any portion of a counselling session, or any materials shared during a session, without the prior written consent of the Counsellor. I understand that any recording made without such consent shall constitute a breach of this Waiver and the Terms of Use.
- I understand and acknowledge that any feedback, rating, or review that I provide in respect of the Services, whether submitted via Google Reviews, electronic mail, text message, or any other platform may, at the Firm’s discretion, be displayed on the Firm’s website, in whole or in part.
